There are two types of "legal actions" under Minnesota law - a divorce, which is called a "dissolution", and a "legal separation". The "act" of "living separately" while going through a divorce is not a "legal separation".
Legal Separation -vs- Divorce
The difference between a legal separation and a dissolution (divorce) is that a dissolution terminates the marriage; a legal separation does not. In a legal separation, the spouses go through all of the motions (property division, custody, maintenance, etc.), and in the end, they are considered "financially separate entities," but they are still married. Conversely, in a divorce, the marriage is ended.
